IF however you found direct evidence the child isn’t properly caring for the infant, then it is a safety issue. But broadly, it isn’t. Particularly in states like Arizona which do not have a minimum age. My recommendation is to find reasonable childcare, in court propose this as part of your custody plan. If you have proof of the 13 year old not being mature enough, like issues where they broke trust, were afraid to be alone, made the wrong call in an emergency. I would bring those up. I have some pause in saying that because I don’t want you assassinating the character of this child, the 13 year old when this isn’t their fault. Also, courts tend to look at daytime hours as being “safer” than night time hours. So if she is doing this with overnights though not illegal the courts would pose a large objection. It’s obviously not fair to the older child who didn’t opt to have a baby at 13 that he effectively had one. ()
